Limited Warranty

HCPRO Products (“we,” “our,” “us”) warrants that our lubricant products (“Products”) are free from defects in material and workmanship and are fit for their intended purpose for a period of 5 years from the date of purchase, provided that the Products are:

  • Used strictly in accordance with the applications and specifications listed on our product data sheets, and

  • Stored under the appropriate conditions outlined by HCPRO.

This limited warranty applies only to Products purchased from authorized HCPRO distributors and used under normal operating conditions.

What This Limited Warranty Covers

HCPRO warrants to the consumer that, at the time of sale, our lubricants:

  1. Are free from defective materials, design, and workmanship.

  2. Are fit for use according to HCPRO’s written recommendations and in applications specified on our product data sheets and labels.

What This Limited Warranty Does Not Cover

This warranty does not apply to:

  • Lubricants not packaged by HCPRO or an authorized HCPRO packager.

  • Lubricants sold by unauthorized dealers.

  • Lubricants used in conjunction with any product or additive not approved by HCPRO.

  • Lubricants contaminated after leaving HCPRO facilities (including improper handling, repackaging, storage, filtration, or use of dirty dispensing equipment).

  • Lubricants used in mechanically deficient equipment (abnormal operation, negligence, abuse, prior damage, or improper modification).

  • Failures due to non-compliance with OEM recommendations for lubricant maintenance, drain intervals, or other pre-existing OEM issues unrelated to HCPRO lubricants.

  • Repairs for normal wear and tear.

  • Failures when HCPRO lubricants are not used per HCPRO’s or the OEM’s written recommendations. Outside of our data sheets, the consumer bears all risk and liability for determining suitability for any non-recommended use.

  • Lubricants used for racing or outside their designated applications.

  • Claims without a preserved, reasonable sample of the allegedly defective lubricant.

  • Damages if the consumer fails to provide parts requested for inspection by HCPRO.

HCPRO’s Remedy for a Covered Defect

If a HCPRO lubricant is proven defective in materials, design, or workmanship, HCPRO Products will, at its option:

  1. Replace the defective lubricant; and

  2. Repair or replace (at HCPRO’s expense) any equipment components damaged by the defective lubricant.

This remedy is the consumer’s sole and exclusive remedy under this limited warranty.

How to Make a Warranty Claim

To file a claim, the consumer must:

  1. Provide a six-ounce representative sample of the failed lubricant in a clean, dry container.

  2. If OEM warranty is implicated, file with the OEM first; if denied, supply a copy of the OEM’s denial letter.

  3. Notify HCPRO within 30 days of the failure or alleged defect.

  4. Retain all failed parts for inspection by HCPRO (unless surrendered to the OEM).

  5. Mail (at your expense) the following to HCPRO Products, Technical Services, 3473 NW 19TH LN Miami, FL 33182 USA:

    • The six-ounce lubricant sample

    • Equipment details (make, model, year, total miles/hours, and duty cycle)

    • Maintenance records (oil change history, repairs, oil analyses)

    • Proof of purchase for the HCPRO product

    • Container batch number used in the failed equipment

    • OEM warranty denial, if applicable

If your claim is approved, HCPRO will reimburse reasonable mailing costs.

After Your Claim Is Filed

  • Cooperate with HCPRO’s technical investigation and provide any requested information.

  • If HCPRO’s insurer pays your claim and seeks recovery from the OEM, you may be asked to assist.

Limitation of Liability

HCPRO’s liability, whether in contract, tort, warranty, or otherwise, is limited to the value of the equipment in which our Products were used. Under no circumstances will HCPRO be liable for special, incidental, or consequential damages (e.g., loss of profits, business interruption, lodging, towing, or replacement equipment costs). Some jurisdictions do not allow exclusion of such damages, so these limitations may not apply to you. All implied warranties (including merchantability or fitness for a particular purpose) are limited to the duration of this express warranty. Some jurisdictions do not allow limitations on implied warranties, so this limitation may not apply to you.

Governing Law

This warranty is governed by the laws of the State of Florida, without regard to its conflict of laws principles. It gives you specific legal rights, and you may have other rights that vary by state.
